1. Introduction
Welcome to MojiMoji! These Terms of Service ("Terms") govern your use of the MojiMoji mobile application and related services (collectively, the "Service") provided by MojiMoji ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Definitions
"Service" refers to the MojiMoji mobile application and all related features and services.
"User" refers to any individual who accesses or uses the Service.
"Marker" refers to the emoji icon and associated content (text, photos) that users create and place on the map.
"Emoji" refers to the digital icons used for profiles, markers, comments, and replies within the Service.
"Emoji Package" refers to a collection of emojis that can be obtained for free or purchased.

3. Eligibility
You must be at least 14 years old to use the Service.
Users under the age of 14 must obtain parental or guardian consent before using the Service.
By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration
To use the Service, you must sign in using a Google account.
You are required to select an emoji profile and set a nickname to complete registration.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information during registration.

5. Service Features

5.1 Markers
Users can create markers on the map at their current location. Markers display the user's selected emoji. Users may optionally add text content and/or photos to their markers. Markers remain on the map until manually deleted by the user or upon account deletion. Location permission is required to create markers.

5.2 Comments and Replies
Users can leave comments on other users' markers using emojis. Users can reply to comments using emojis. All comments and replies are displayed using emoji icons only.

5.3 Emoji System
Users can obtain emojis through free acquisition (receiving free emojis through the Service) or purchase (buying emoji packages through in-app purchases). Purchased emojis are non-refundable except as required by applicable law. Emojis are for personal use only and cannot be transferred to other accounts.

5.4 Push Notifications
Users may receive push notifications about comments on their markers and other activities. Users can manage notification preferences in the app settings.

6. Purchases and Payments

6.1 In-App Purchases
Emoji packages and other digital content may be purchased through the app. All purchases are processed through the applicable app store (Google Play Store or Apple App Store). Prices are displayed in local currency and may vary by region.

6.2 Refunds
Refund policies are governed by the respective app store's terms. We do not provide refunds for digital content once delivered, except as required by applicable law.

6.3 Free Emojis
Free emojis may be offered through promotions, events, or regular distributions. Free emojis have the same functionality as purchased emojis.

7. User Content

7.1 Content You Create

You are solely responsible for any content you create through the Service, including marker text, photos, and emoji usage. You retain ownership of content you create. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

7.2 Content Guidelines
You agree not to post content that is illegal, harmful, threatening, abusive, harassing, or defamatory; contains nudity, sexually explicit material, or pornography; infringes on intellectual property rights of others; contains personal information of others without consent; or is spam or commercial advertising.

8. User Conduct
You agree not to: collect, store, or disclose other users' personal information without consent; use the Service to harass, threaten, stalk, or harm others; use automated means to create excessive markers or comments; interfere with or disrupt the normal operation of the Service; transmit false or misleading location information; violate any applicable laws or regulations; impersonate another person or entity; attempt to gain unauthorized access to other users' accounts; or exploit bugs or vulnerabilities in the Service.

9. Intellectual Property
All intellectual property rights in the Service, including but not limited to design, logos, software, emoji designs, and content, are owned by MojiMoji or its licensors. You may not copy, modify, distribute, or create derivative works based on the Service or its content without our express permission. Purchased emojis grant you a license to use them within the Service; they do not transfer ownership of the emoji designs.

10. Termination and Suspension

10.1 By User
You may terminate your account at any time through the app settings. Upon account deletion, all personal information and activity records will be permanently deleted. Purchased emojis and content will be forfeited upon account deletion.

10.2 By MojiMoji
We may suspend or terminate your access to the Service if you violate these Terms; you violate our Content Guidelines; we receive verified reports from other users; we detect abnormal usage patterns or fraudulent activity; or it is required by law.

11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee the accuracy, completeness, or reliability of any user-generated content. We are not responsible for disputes between users. We are not liable for any loss of purchased content due to account termination for Terms violations.

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim. We are not liable for any loss or damage resulting from user-generated content.

13. Indemnification
You agree to indemnify and hold harmless MojiMoji and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service; content you create or post through the Service; your violation of these Terms; or your violation of any third-party rights.

14. Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes at least 7 days before they take effect through in-app notifications. Your continued use of the Service after changes constitute acceptance of the modified Terms.

15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Korea. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
